Appellant was in the respondents employment as an Engineer manning its mechanical plant at Ibadan. Respondent had found some fraudulent practices in the appellants unit which led to an investigation panel been set up. The panel indicted the appellant and that led to his dismissal.

Appellant sued seeking the enforcement of his fundamental Human Rights and a declaration that the respondents decision to dismiss him was unconstitutional, illegal, null and void, a declaration that the panel's finding was unconstitutional, null and void and an order quashing the findings; on order reinstating appellant to his past and an order for respondent to pay appellant all his salaries, allowances and entitlements.

Trial Judge struck out the appellants application consequent upon which an appeal was lodged.
